Chances are you will be receiving a summons to attend court in the mail if you were actually arrested for DUI. You know you are arrested when the police officer places you in custody for any period of time. You know you were arrested because the officer would have read you your Miranda Rights (ie. “you have the right to remain silent…”) and he or she would have placed hand cuffs on you.

An officer merely stopping your car and asking you questions does not mean you were arrested or in custody. The government has 3 years to file formal charges against you, and if you blew over the legal limit, chances are they will. It typically takes 3 weeks to get a court date in the mail. If you have been arrested, be proactive and start investigating your legal options because the date can come fast.
